In most cases in Pennsylvania you have two years from the date of the injury to file a lawsuit. If you do not file by that time, there is something called a Statute of Limitations, which now limits you from filing a claim. It is very important to consult with an attorney sooner rather than wait. That way you can be sure that when the time comes, if the case has not settled, you are ready to file the lawsuit to preserve your rights.
It is not a good idea to settle with the insurance company yourself. The insurance industry is in the business of making money, not giving it away. You can be sure that if you settle yourself, you will get less in your pocket than if you had an attorney.
